Democrat ends all-night speech as Supreme Court clash nears

Yet, Gorsuch's nomination has come against stiff opposition by Senate Democrats.

Joe Donnelly's constituents with direct mailings and web ads, are taking a lot of the credit for Donnelly announcing that he is one of only three Democratic senators supporting Neil Gorsuch's confirmation to the Supreme Court. In the face of the filibuster, McConnell would be expected to force through the rule change, leading to a final vote on Friday evening to confirm Gorsuch by a simple majority. On Sunday, McConnell said, "Judge Gorsuch is going to be confirmed".

Democrats are angry that Republicans refused to hold hearings past year on Merrick Garland, President Obama's nominee to replace Justice Antonin Scalia.

Democrats have accused Gorsuch of being insufficiently independent of Trump, evading questions on key Supreme Court rulings of the past including on abortion and political spending, and favoring corporate interests over ordinary Americans. And while this unbalanced approach might make for interesting reading, the courtroom is not an academic paper.

Merkley's lengthy speech made for drama but had no chance to change the outcome.

Merkley isn't technically filibustering Gorsuch's nomination, because Senate Majority Leader Mitch McConnell has already filed for a move to vote, triggering a 30-hour debate period. According to the New York Times, Democrats have enough votes to impose a filibuster, a procedural tactic used to delay and derail voting on a policy nomination. "They need to reconsider".

Sen. John Thune, R-S.D., blamed Democrats on Tuesday, saying they were the ones invoking the "nuclear option" by filibustering Gorsuch.

The party's other option is to change the Senate rules, what many call the "nuclear option".

"293 days without a fair hearing or vote. Schumer convinced Democrats to routinely filibuster judges", McConnell said, referring to Minority Leader Chuck Schumer. "If Judge Gorsuch is unacceptable to our Democratic colleagues, there will never be a nominee by this president that you will find acceptable. That could not be further from the truth".

In fact, a Senate rules change does appear to be Republicans' one route to put Gorsuch on the court. "We should now get in a room and come up with a compromise to avoid the nuclear option that so many Republicans are reluctant to take".

For Republicans and Trump, Gorsuch's confirmation would be a moment of triumph, a bright spot in a troubled young administration that's failed on the legislative front with the health care bill and is under investigation over Russian Federation connections.

It's with this in mind that the Republicans are only changing the rules regarding filibusters on Supreme Court nominees, and not regarding legislation.

"I'm here at 4:20 in the morning because so much is at stake in terms of the legitimacy of the court", Merkley said as he stood on the floor surrounded by a few charts to help keep him on track.

"The most conservative Democrat is still more liberal than the most liberal Republican".

Both parties have historically been hesitant to do away with the filibuster. For example, McConnell could agree to lots of Democrat-favored spending increases to get to 60 votes.

Last year, Republicans notably did not allow an up-or-down vote on Merrick Garland, President Obama's nominee for the court vacancy.

However, as the Post detailed in a separate Wednesday article, the OR politician's extended speech is not a filibuster.

Gorsuch, 49, is a 10-year veteran of a federal appeals court in Denver, where he's compiled a highly conservative record that's led Democrats to complain that he too often sides with corporations without regard to the humanity of the plaintiffs before him.
